These Programme Booking Conditions apply to a confirmed programme arranged or coordinated by Samurai Japan K.K. (“Samurai Japan”, “we”, “us”, “our”). They supplement the quotation, itinerary, invoice, confirmation and any special conditions issued for the programme.
The programme-specific documents together form the contractual record for the booking. If they conflict, the order of precedence is: (1) mandatory Japanese law; (2) special conditions expressly agreed in writing for the programme; (3) the booking confirmation; (4) the quotation and itinerary; and (5) these conditions.
Samurai Japan coordinates and arranges travel-related services through hotels, ryokan, transport operators, guides, venues, restaurants, attractions and other suppliers. The quotation or confirmation will identify the services arranged and, where relevant, the supplier responsible for delivering them.
Samurai Japan does not represent that it operates every underlying supplier service. Our responsibilities are determined by the agreed programme documents, the nature of the arrangement and mandatory Japanese law.
The booking becomes confirmed only when Samurai Japan issues written confirmation and the required payment conditions in the quotation or invoice have been satisfied.
Payment deadlines, currencies, bank charges, card charges and any applicable deposits will be stated in the programme documents. If payment is late, Samurai Japan may be unable to secure services and may treat the affected services as cancelled where permitted by the applicable supplier conditions and law.
We will use reasonable efforts to accommodate requested changes. Changes may generate supplier amendment charges, fare or accommodation differences, guide or transport charges, administrative charges and exchange-rate differences. We will communicate known additional costs before confirming the change where reasonably practicable.
The cancellation schedule applicable to each programme will be stated in the quotation, booking confirmation or special conditions. This is because supplier cancellation deadlines and non-refundable amounts vary materially by hotel, transport operator, attraction, guide, venue, season and group size.
Unless a programme-specific document states otherwise, cancellation amounts may include non-refundable supplier charges, supplier cancellation penalties and reasonable handling or administrative costs that Samurai Japan is entitled to charge under the agreed contract and applicable law.
Failure to attend a confirmed service, late arrival, missed transport, failure to reach a meeting point or other traveller-related failure may be treated as a no-show. Refunds and replacement-service costs will be determined by the applicable supplier and programme conditions.
Suppliers, vehicles, guides, hotels, venues and experiences may occasionally become unavailable because of weather, safety issues, closure, operational requirements, supplier failure, government restrictions or other circumstances outside our reasonable control.
Where reasonably necessary, we may arrange a reasonably comparable alternative. If a material reduction in the contracted service occurs and an adjustment is required by the programme contract or mandatory law, the appropriate adjustment will be made.
Where private or charter transport is arranged, the transport service will be provided by an appropriately licensed Japanese operator where required. Vehicle make, model, colour and configuration may vary from illustrations or requests unless a specific vehicle has been expressly confirmed in writing.
Travellers are responsible for valid passports, visas, immigration permissions and other required travel documents. Information supplied by Samurai Japan is for assistance and should be verified with the relevant authorities, embassy or consulate. We do not guarantee admission to Japan or any other country.
Unless expressly included, travel insurance is not provided. Appropriate insurance is strongly recommended, including cover for medical expenses, evacuation, cancellation, interruption, baggage and personal liability.
Travellers and booking agencies must provide accurate information reasonably required to deliver the programme, including names, dates, group size, luggage, accessibility, dietary, mobility and emergency-contact information. Changes must be reported promptly.
Special requirements are subject to supplier capability and availability. We will use reasonable efforts to accommodate disclosed requirements but cannot guarantee that every supplier or facility can accommodate every need.
Educational and youth programmes may require separate safeguarding, supervision, emergency and participant-information procedures. The responsible institution or adult remains responsible for participant supervision unless expressly agreed otherwise.
Meetings, incentives, conferences, exhibitions and corporate programmes may have special conditions covering deposits, room blocks, production costs, venues, staffing, security, overtime, transport and cancellation. Those special conditions prevail where expressly agreed.
Neither Samurai Japan nor a supplier will be responsible for delay or failure caused by circumstances beyond reasonable control, including earthquake, tsunami, typhoon, volcanic activity, severe weather, fire, epidemic or pandemic, war, terrorism, civil unrest, strikes, transport disruption, government action, infrastructure failure or supplier insolvency.
We will take reasonable steps to assist affected travellers and minimise disruption. Nothing in these conditions excludes liability or rights that cannot lawfully be excluded.
Samurai Japan's liability is governed by the programme documents, the nature of the services arranged and mandatory Japanese law. We are not responsible for losses caused solely by inaccurate information supplied by the traveller or booking agency, third-party services outside our contractual responsibility, or circumstances outside our reasonable control, except to the extent mandatory law provides otherwise.
Nothing in these conditions excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, wilful misconduct, or death or personal injury where such exclusion would be unlawful.
Problems should be reported immediately to the programme contact so that we can attempt to resolve them during the programme. A written complaint should be submitted as soon as reasonably practicable after the relevant event. Failure to report a problem promptly may make investigation or mitigation more difficult but does not waive a mandatory legal right.
Personal information is handled under the Samurai Japan Privacy Policy. Programme-specific handling may also be governed by supplier or institutional privacy requirements where applicable.
These conditions are governed by the laws of Japan, subject to mandatory rights that cannot lawfully be excluded. Unless a programme-specific agreement validly provides otherwise, the Chiba District Court shall have jurisdiction as the court of first instance for disputes arising from these conditions.
